Can you copyright AI-generated content?
Not if a machine created it on its own with no human shaping the expression. That kind of output can't be copyrighted by anyone, including you. But you can copyright the human authorship inside a work that also contains AI material, such as your creative selection, arrangement, editing, and your own writing.
Do I actually have to register my course to be protected?
No. Your copyright exists the moment you fix the work in a tangible form, with no filing required. Registration is a separate, voluntary step that puts your claim on the public record and, in the United States, is what lets you enforce it in court. Most solo creators are best served registering the flagship assets, like a signature course or book, rather than every post and email. Check the current rules on copyright.gov.
Where do I actually register, and what do I type?
Registration runs through the electronic system you reach from copyright.gov, and you don't need a paid filing service. Choose the application type that matches the work, describe your human contribution in the Author Created field using the Office's own wording about selection, coordination, and arrangement, and use the limitation of claim section to exclude the AI-generated material you're not claiming.
What did Thaler v. Perlmutter actually decide?
The D.C. Circuit ruled that a work authored entirely by an AI system can't be registered, because the Copyright Act of 1976 requires a human author. The Supreme Court denied certiorari on its order list dated March 2, 2026, which leaves that ruling standing as law.
Do I have to tell the Copyright Office I used AI?
Yes. The Office's guidance says applicants have a duty to disclose the inclusion of AI-generated content, and any more-than-trivial AI-generated material must be disclaimed in the registration application. You claim your human contribution and exclude the machine's part.
If I heavily edit AI output, does it become mine?
Your creative contributions can be protected. The Office compares AI to tools like Photoshop and says what matters is how much creative control the human had over the work's expression. Meaningful editing, selection, and arrangement are exactly the human authorship copyright protects.
Who owns the output, me or the AI company?
It depends on the tool's terms. Anthropic's consumer terms assign you the output rights, with an 'if any' hedge that lines up with the law: whatever ownership exists is handed to you. Read the current terms of whatever tool you use, since they differ on indemnity and on whether the company will defend you against a claim.
Does this mean my brand name and logo are protected too?
No. Those are trademark questions and live under a different body of law, which this case didn't touch. Whether AI helped you design the mark doesn't change that. Treat protecting a name or logo as its own project with its own specialist.
